FDA Regulatory Notice: As of September 12, 2026, 48 vape products from 5 brands (Vuse, NJOY, Logic, JUUL, and Glas) have received FDA PMTA marketing authorization. All other vape products on the market are sold under FDA enforcement discretion, which was updated in May 2026. State laws may independently restrict or prohibit these products regardless of federal enforcement posture.
State Law Notice: Six states (CA, MA, NJ, NY, RI, UT) maintain statewide flavor bans. Seventeen states maintain PMTA product directories. Texas maintains an origin ban on Chinese-made vapes. Ten states have local-only flavor restrictions. Four states have pending flavor ban legislation. Always verify your state and local regulations before purchasing any vape product.
