Statement of Business Scope

Windbar ("the Company") provides OEM/ODM e-cigarette manufacturing support — including structural and industrial design, flavor and process collaboration, and product evaluation — along with community services, to e-cigarette manufacturers, brand owners, and compliant business operators, built on the Company's core advantage in battery technology. The Company itself does not sell finished e-cigarette products directly to end consumers.

The Company's technical support and services are limited to e-cigarette products verified by third-party testing to contain 0mg nicotine and no tobacco-derived ingredients, in compliance with applicable regulations, within a capacity range of 1ml, 2ml, and 3ml. Supporting test reports are maintained on file and this statement will be updated if test results change.

The Company additionally provides OEM/ODM manufacturing support for empty vaping hardware compatible with CBD use, limited strictly to the device/hardware itself. The Company does not fill, formulate, supply, or otherwise handle any CBD e-liquid, hemp extract, or THC-containing material — all such content is sourced and filled solely by the brand partner. Accordingly, the Company makes no representation regarding the THC or CBD content of any finished, filled product and bears no responsibility for a brand partner's compliance with the federal hemp definition under 7 U.S.C. § 1639o, as amended by P.L. 119-37 (effective November 12, 2026, which replaces the prior 0.3% delta-9-only standard with a total-THC calculation plus a 0.4 mg total-THC-per-container cap on finished consumable products). Brand partners are solely responsible for ensuring their filled products meet this standard and all applicable state law. The Company does not manufacture, sell, or supply any THC-containing devices, and does not provide or assist in producing e-liquids or formulations containing CBD/THC. Any flavor or process collaboration with overseas manufacturing partners is limited strictly to compliant zero-nicotine e-liquids and does not extend to the research, formulation, or supply of CBD/THC e-liquids.
