For Adult Vapers
The draft guidance does not change what you can legally buy today. Only 48 products are FDA-authorized. If the guidance is finalized, it may expand access to lower-risk flavors (menthol, mint, coffee, tea) through clearer PMTA pathways, while higher-risk flavors (fruit, candy, dessert) will remain harder to bring to market legally. The Glas G2 precedent suggests that future flavored products may require DAR-like age-gating technology.
For Retailers
The May 8 enforcement guidance creates a gray area: unauthorized products with pending PMTAs may be sold without prioritized enforcement — unless they have "presumptively underage-appealing elements." However, this is enforcement discretion, not authorization. Retailers should stock from the 48 authorized products and check our retailer compliance checklist for full guidance.
For Manufacturers
The draft guidance provides clearer evidentiary expectations but imposes stricter scrutiny on higher-risk flavors. Manufacturers relying on DAR technology should note the draft's cautious stance — DAR may not be sufficient alone for the highest-risk flavors. The Supreme Court's Wages and White Lion decision closes off legal challenges to the comparative efficacy framework. The path forward requires substantial adult-switching evidence combined with effective youth-access prevention.
