1. Buying in a flavor-ban state. California (AB 762), Massachusetts, New York, New Jersey, and Rhode Island maintain flavor restrictions that prohibit or severely limit the sale of flavored disposable vapes. If you live in one of these states, none of the five devices reviewed here may be legally available in flavors. See our California AB 762 guide for a detailed breakdown of state laws.
2. Ignoring FDA enforcement discretion. FDA softened its enforcement guidance in May 2026, allowing non-PMTA products to remain on the market under certain conditions. However, this is not a permanent guarantee. Enforcement could resume, and states may independently act. Always check current regulations before purchasing.
3. Overpaying for a dying device. Disposable vapes degrade over time. If a device has been on a shop shelf for months, the coil may be compromised and the battery may have degraded. Check manufacturing dates when possible, and avoid deeply discounted devices that may be close to expiration.
4. Choosing puff count over flavor quality. A 20,000-puff device is only good if the flavor holds up. Some high-puff devices sacrifice coil quality to reach the number. The Elf Bar BC5000 may have fewer puffs, but its flavor consistency from first to last puff is the best in this comparison.
5. Assuming all flavors are equal. Lost Mary's Baja Splash is trending for a reason — it is genuinely excellent. But the 12-flavor catalog means you have fewer backup options if you do not like the first one you try. Elf Bar's 50+ flavors give you more room to experiment.
