Not all retailers are created equal. Here's how to distinguish legitimate sellers from the gray market:
Authorized Retailers (Safest)
- National chains: Gas stations, convenience stores, and pharmacies that carry FDA-authorized brands (Vuse, NJOY are most widely available)
- Brand-direct: JUUL.com, NJOY.com, and Glas.com sell directly with full age verification
- Licensed vape shops: Reputable shops that can show their state tobacco license and only stock PMTA-authorized products
Gray Market (Risky)
- Unlicensed online sellers: Websites selling Elf Bar, Geek Bar, and other unauthorized brands ship from overseas, bypassing FDA enforcement
- Social media sellers: Instagram, TikTok, and Facebook accounts selling vapes often carry counterfeits
- Flea markets and pop-up shops: No age verification, no product authentication, no accountability
Rule of thumb: If a retailer sells Elf Bar, Geek Bar, or any brand not on the FDA authorized list, they are violating federal law — and you should question the authenticity of everything else they sell.
