Shopify did not act in a vacuum. The platform's move followed sustained, coordinated pressure from a bipartisan coalition of roughly 25 U.S. state attorneys general — a group that had been targeting the illegal e-cigarette market, which it characterized as a multi-billion-dollar problem.
The pressure campaign produced public, on-the-record wins for the attorneys general within days:
- Illinois — Attorney General Kwame Raoul's office announced that Shopify would ban all e-cigarette sales following a call for action from Raoul and a coalition of attorneys general.
- California — Attorney General Rob Bonta publicly welcomed the ban, framing it as a response to the coalition's request.
- Massachusetts — The attorney general's office also publicized the outcome, describing it as the result of an AG-led action.
The coalition's stated target was the illegal e-cigarette market. But the remedy Shopify adopted was not surgical — it was category-wide. That distinction is the crux of the entire story: regulators aimed at unlawful sellers, and the platform responded by removing the category, lawful sellers included.
The key mismatch: Attorneys general targeted the illegal segment of the market. Shopify's response removed the entire ENDS category. FDA-authorized products, state-licensed retailers, and compliant merchants were swept up along with unauthorized imports. When a platform acts on category rather than conduct, the compliant operator is collateral damage — and the compliant operator is exactly who a well-designed enforcement regime would want to keep.
This is a pattern worth understanding well beyond vaping. When public pressure reaches a platform, the platform's cheapest and lowest-risk response is almost always to exit the category entirely rather than to build a compliance-verification regime. Verifying which merchants are lawful is expensive, slow, and legally exposed. Removing the category is instant, cheap, and defensible. That asymmetry — not any judgment about vaping itself — is what produced the Shopify ban.
