It's important to note that the November 12 change is a federal rule. States may have their own rules:
- States with bans already in place: Several states already banned delta-8, THCA, or hemp-derived THC before the federal rule. These states will see less change.
- States with legal recreational cannabis: Consumers in legal states may simply shift to regulated cannabis products. Less disruption for consumers, more for the hemp retail channel.
- States with legal medical cannabis: Some patients may shift to medical cannabis if they qualify.
- States with no legal cannabis: Consumers in prohibition states will lose access entirely unless they switch to nicotine or move to the unregulated market.
- States setting their own hemp rules: Some states may set more lenient total-THC thresholds or create their own regulatory frameworks, though federal law still applies to interstate commerce.
