Vape & Smoke Shops High Impact
The biggest impact on the vape industry will be felt at the retail level. Many vape shops and smoke shops derive 30-60% of their revenue from hemp-derived products — delta-8 cartridges, THCA disposables, CBD vapes, and gummies. When these products become Schedule I, shops can no longer sell them.
What to expect:
- Revenue drop: Shops heavily dependent on hemp products will see revenue drop 30-50%+ overnight
- Store closures: Some smaller shops won't survive the revenue loss
- Inventory fire sales: Expect heavy discounting in late October and early November as shops clear inventory
- Pivot to nicotine: Many shops will try to double down on nicotine vapes, but the market is competitive
- Shift to legal cannabis: Shops in legal states may pivot toward cannabis accessories
Nicotine Vape Brands Net Positive (Indirect)
For nicotine vape brands like Vuse, JUUL, and NJOY, the hemp crackdown could actually be a net positive. Here's why:
- Consumer migration: Some people who used both hemp vapes and nicotine vapes may shift fully to nicotine
- Less competition: Hemp disposables competed with nicotine disposables for consumer dollars
- Retailer focus: Vape shops will have more shelf space and marketing focus for nicotine products
- FDA-authorized benefit: As more unregulated products get squeezed out, FDA-authorized products look more attractive

Disposable Vape Market Moderate Impact
The disposable vape market will see a split impact:
- Hemp disposables (THCA, delta-8): Gone. These are the biggest single category being eliminated.
- Nicotine disposables (Elf Bar, Lost Mary, etc.): Indirect boost — less competition from hemp disposables. But they face their own regulatory pressure from the FDA.

Online Vape Retailers & Marketplaces Moderate Impact
Online retailers that carry both nicotine and hemp products will see their hemp SKUs disappear. Platforms like Shopify (which already banned nicotine vapes) will need to enforce the total-THC rule for hemp products too.
