Before building your verification process, it's essential to understand the three statutory pathways for FDA tobacco product authorization:
- PMTA (Premarket Tobacco Product Application) — The primary pathway for new e-cigarette products. Requires extensive scientific evidence demonstrating the product is appropriate for the protection of public health.
- SE (Substantial Equivalence) — For products that are substantially equivalent to a predicate product on the market before February 15, 2007.
- EX REQ (Exemption from Substantial Equivalence) — A narrow exemption pathway for certain products.
For the vast majority of e-cigarette products sold today, PMTA is the relevant pathway. And within the PMTA process, the Marketing Granted Order (MGO) is the gold standard — it means the FDA has formally reviewed and authorized the product.
Enforcement priority ≠ authorization. The May 2026 FDA guidance describes circumstances where the agency does not intend to prioritize enforcement for certain products with pending PMTAs. This is an enforcement discretion policy — it is NOT marketing authorization. Products in this category are still technically unauthorized, and the policy can change.
