This is the most confusing part of US vape regulation, and it's where most "ban" headlines come from.
What is PMTA?
The Premarket Tobacco Product Application (PMTA) process requires all vape products on the market to apply for FDA authorization. Companies must submit extensive scientific data proving their products benefit public health (primarily by helping adult smokers quit).
Where Things Stand
- ~48 products authorized β mostly tobacco-flavored pod products from JUUL and a few other companies
- Millions of products "technically unauthorized" β everything from your favorite fruit-flavored disposable to most pod systems
- FDA enforcement priorities β the agency focuses on products most likely to appeal to kids (fruit flavors, cartoon packaging, disposables)
So while most vape products aren't "banned" by name, they also don't have FDA approval. The FDA chooses which unauthorized products to enforce against, creating a de facto situation where some products are tolerated and others are targeted.
