US vape regulation is becoming increasingly product-specific — not brand-specific. The FDA is both authorizing new products and cracking down on unauthorized ones. If you buy, sell, or review vaping products, understanding the difference between "PMTA submitted" and "FDA authorized" is no longer optional.
In May 2026, the FDA updated its enforcement priorities, targeting unauthorized e-cigarettes and nicotine pouch products. At the same time, the agency continued issuing new authorizations — including Glas flavored pods in May and JUUL2 in August 2026. The market is shifting from "everything is a gray area" to "specific products are legal, everything else isn't."
Important: An authorized brand does not mean every product from that brand is authorized. Authorization is granted at the SKU level — specific device, specific pod, specific nicotine strength, specific flavor. Always check the exact product, not just the brand.
